1. Definitions
In these terms and conditions, the following definitions apply:
Organiser: Amina's Soul Travel VOF, established at Sintekrijnsputje 8, 4661 LM Halsteren, the Netherlands, Dutch Chamber of Commerce number 42075678.
Traveller: any person who books, wishes to book or on whose behalf a trip is booked.
Lead booker: the traveller who makes the booking and also acts on behalf of any fellow travellers.
Trip: the trip, retreat, group trip, camp or package travel offered by Amina's Soul Travel.
Package travel: a combination of travel services as referred to in Book 7, Title 7A of the Dutch Civil Code.
Travel service provider: a third party that performs part of the trip, such as an accommodation, guide, transport partner, diving school or yoga teacher.
Agreement: the travel agreement between Amina's Soul Travel and the traveller.
In writing: by email, booking form, WhatsApp or other digital communication that can be stored.
2. Applicability
These travel terms apply to all offers, bookings, agreements and trips of Amina's Soul Travel, unless otherwise agreed in writing.
Where the trip qualifies as package travel, the mandatory statutory rules for package travel also apply. If a provision of these terms conflicts with mandatory law, the statutory rule will apply.
Deviations from these terms are valid only if Amina's Soul Travel has confirmed them in writing.
3. Information before booking
Before the traveller books, Amina's Soul Travel provides clear information about the destination, travel duration, programme content, included and excluded items, price, payment terms, cancellation terms, minimum number of participants, contact details, any participation requirements and relevant travel document or health information.
The traveller is responsible for carefully reading the information provided and for asking questions in good time if anything is unclear.
4. Booking and formation of the agreement
A booking is formed after the traveller has accepted the offer and Amina's Soul Travel has confirmed the booking in writing. An automatic receipt confirmation is not yet a final booking confirmation.
Amina's Soul Travel may refuse a booking if there is a reasonable ground for doing so, for example if participation is not responsible for safety, health or organisational reasons.
The lead booker is responsible for the accuracy of all details for themselves and any fellow travellers, such as names, contact details, dates of birth, dietary wishes, medical information relevant to participation and any diving experience.
5. Content of the trip
The trip includes only the items expressly stated in the offer, booking page, travel programme or booking confirmation.
Unless stated otherwise in writing, international flights, visas, travel and cancellation insurance, personal expenses, tips, extra excursions and medical costs are not included.
Amina's Soul Travel may adjust the daily programme if local circumstances, safety, weather conditions, availability or instructions from local authorities make this necessary. The nature and quality of the trip will be preserved as much as possible.
6. Price and payment
The travel price is stated in the offer or booking confirmation. The price is based on the costs, exchange rates, local rates, taxes and charges known at that time.
Payment is made according to the payment schedule stated in the booking confirmation or on the website. If the traveller does not pay on time, Amina's Soul Travel may send the traveller a written reminder to pay within a reasonable period.
If payment is still not made after this reminder, Amina's Soul Travel may terminate the agreement. In that case, cancellation fees or costs already incurred may be charged.
Price increases after booking are possible only if they result from changes in transport costs, taxes, charges, exchange rates or other price factors permitted by law. A price increase will be communicated to the traveller no later than 42 days before departure, and never later than 20 days before departure. In the event of a price increase of more than 8%, the traveller may terminate the agreement without cancellation fees within the reasonable period set by Amina's Soul Travel.
7. Payment in case of cancellation by the traveller
The traveller may cancel the trip before departure. Cancellation must be made in writing. The date on which Amina's Soul Travel receives the cancellation is the cancellation date.
In case of cancellation by the traveller, the traveller owes the following cancellation compensation:
- •Up to the 42nd calendar day before departure: The deposit, with a maximum of 35% of the total travel price
- •From the 42nd calendar day to the 21st calendar day before departure: 60% of the total travel price
- •From the 21st calendar day to the 14th calendar day before departure: 80% of the total travel price
- •From the 14th calendar day before departure, in case of no-show or early termination of the trip: 100% of the total travel price
8. Cancellation by Amina's Soul Travel
Amina's Soul Travel may cancel the trip if the minimum number of participants is not reached, if performance becomes impossible or unsafe due to unavoidable and extraordinary circumstances, or if local circumstances seriously hinder the performance of the trip.
If Amina's Soul Travel cancels the trip, it will inform the traveller as soon as possible. Where possible, the traveller will be offered an alternative. If the traveller does not accept the alternative, Amina's Soul Travel will refund the travel price already received within the statutory period. Costs for services outside the travel agreement, such as flights, visas, insurance or personal preparation costs, will not be reimbursed.
9. Changes before departure
If Amina's Soul Travel has to change an important part of the trip before departure, the traveller will be informed in writing as soon as possible. The traveller will then be given the choice to accept the change, accept a suitable alternative or terminate the agreement without cancellation fees, insofar as the law provides.
Minor changes, such as a different order of activities, an adjusted time or a comparable local replacement, do not give a right to cancel free of charge if the trip remains equivalent in nature and quality.
10. Performance, responsibility and liability
Amina's Soul Travel is responsible for the proper performance of the travel services that form part of the agreement, even when those services are performed by local partners or other travel service providers.
If part of the trip is not performed in accordance with the agreement, the traveller must report this to Amina's Soul Travel or to the tour leader on site as soon as possible. Amina's Soul Travel will be given the opportunity to resolve the problem, unless this is impossible or would involve disproportionate costs.
Amina's Soul Travel is not liable for damage caused by the traveller, by third parties not involved in the performance of the trip, or by unavoidable and extraordinary circumstances. This limitation does not apply to liability that may not be excluded by law.
11. Help and assistance during the trip
If the traveller gets into difficulty during the trip, Amina's Soul Travel will provide appropriate help and assistance. This may include information about medical assistance, local authorities, consular assistance, communication with family or insurer, or help with alternative travel arrangements.
If the difficulties were caused intentionally or negligently by the traveller, Amina's Soul Travel may charge a reasonable fee for the assistance provided, up to the actual costs.
12. Health, safety and participation requirements
Trips by Amina's Soul Travel may include physical and mental activities, such as hiking through wadis, yoga, meditation, local activities and diving. Before booking, the traveller must assess whether they are physically and mentally able to participate safely.
Relevant health information, allergies, dietary wishes, medication use, physical limitations, mental health issues or other circumstances that may affect participation must be reported to Amina's Soul Travel before departure.
Amina's Soul Travel may refuse or limit participation in an activity if this is necessary for the safety of the traveller, the group, guides or local partners. Traveller safety comes first.
13. Diving, yoga and activities
For diving, the safety rules, instructions and participation requirements of the diving school or instructor apply. The traveller must follow all instructions and honestly disclose relevant medical information. Diving under the influence of alcohol, drugs or unsuitable medication is not permitted.
For yoga, meditation and hiking activities, the traveller participates within their own limits. The traveller remains responsible for indicating pain, complaints, boundaries or medical limitations.
Amina's Soul Travel recommends travel insurance that covers medical costs, activities, diving where applicable, rescue costs and repatriation.
14. Travel documents, visas, insurance and border control
The traveller is fully responsible for valid travel documents, visas, any vaccinations, health requirements, insurance and compliance with the rules of airlines, airports, customs, border control and local authorities.
Amina's Soul Travel is not responsible if a traveller is refused by an airline, airport, customs, border authority or local authority, for example because of missing or incorrect documents, insufficient passport validity, visa problems, safety rules or other entry requirements.
All costs and consequences arising because the traveller does not meet these requirements are for the traveller's account. In that case there is no right to refund of the travel price, unless mandatory law provides otherwise.
15. Complaints
A complaint or problem during the trip must be reported as soon as possible to the tour leader, local contact person or Amina's Soul Travel, so that a solution can be sought.
Complaints after the trip must be reported in writing as soon as possible via aminassoultravel@travelcompany.info, with a clear description and any supporting evidence. Preferably this should be done within 14 days after return. This period is a guideline and not an automatic expiry period. If a complaint is not reported in time while this was possible, this may affect the assessment of the complaint.
16. Traveller conduct and damage
The traveller behaves respectfully towards fellow travellers, guides, local partners, residents and the environment. The traveller follows reasonable instructions from Amina's Soul Travel, tour leaders, guides, instructors, accommodations and local partners.
Amina's Soul Travel may exclude a traveller from further participation if the traveller's conduct causes danger, serious nuisance, discrimination, harassment, threats, damage, destruction or serious disturbance.
Extra costs, damage, fines or repair costs resulting from the traveller's conduct, for example damage to accommodation, loss of materials, damage to transport, damage at local partners or costs caused by failing to follow instructions, are for the traveller's account.
17. Unavoidable and extraordinary circumstances
Unavoidable and extraordinary circumstances are situations beyond the control of Amina's Soul Travel whose consequences could not have been avoided despite reasonable measures. Examples include natural disasters, war, terrorism, serious safety problems, epidemics, pandemics, government measures, strikes, extreme weather conditions or sudden local restrictions.
In such situations, Amina's Soul Travel will look for reasonable solutions, such as adjusting the programme, providing replacement services or moving parts of the trip. Rights to change, termination, refund or compensation will be assessed according to the applicable statutory rules and these terms.
18. Insolvency protection - VZR Garant
Amina's Soul Travel is affiliated with VZR Garant. For trips that fall under the guarantee scheme, VZR Garant provides protection in the event of financial insolvency of Amina's Soul Travel according to the terms of VZR Garant.
This protection concerns the refund of prepaid travel sums and, if passenger transport is part of the trip and the traveller is already at the destination, repatriation insofar as this falls under the guarantee scheme. The exact coverage and conditions follow from the VZR Garant guarantee scheme.
19. Privacy, photographs and social media
Amina's Soul Travel processes personal data in accordance with its privacy statement. Personal data is used for booking, communication, performance of the trip, safety, administration and legal obligations.
Photo and video recordings may be made during the trip for memories, promotion, the website and social media. Amina's Soul Travel asks for consent in advance before recognisable images of a traveller are used for commercial or public promotion. Once the traveller has given this consent, it will not be requested again during the trip and Amina's Soul Travel will assume that the traveller agrees to the use of recognisable images for the purposes mentioned.
Travellers may not publish images of other travellers without consent where those images are privacy-sensitive, uncomfortable, harmful or recognisable in a way the other person does not want.
20. Insurance
The traveller is responsible for taking out suitable travel, medical, cancellation and, where applicable, diving or activity insurance. Amina's Soul Travel is not liable for costs that are not reimbursed because insurance is missing or insufficient.
21. Applicable law and disputes
The agreement and these terms are governed by Dutch law, unless mandatory consumer law provides otherwise.
Disputes will first be discussed in consultation. If the parties cannot resolve the dispute together, it may be submitted to the competent court in the Netherlands.
